How to Hire Employees in Brazil: Costs, CLT Rules and EOR Options

What a CLT employee costs in Brazil at three salaries, how an employer of record compares with a Ltda or a PJ contract, and the 2026 changes to working hours, income tax and paternity leave that affect a first hire.

Overview

Three routes into Brazil, and a working week that shrinks in December

An overseas company has three workable routes into Brazil: register a limitada (Ltda) with a Brazil-resident administrator, employ through an employer of record that already holds a CNPJ and an eSocial registration, or pay a PJ, a worker who invoices through their own company. The PJ route is the one labour courts unwind most often. For a first team of under ten people, an EOR is the right route, because a Ltda takes months to register and still needs a local accounting firm to run CLT payroll.

Cost comes from what sits on top of twelve salaries. A CLT employee receives a 13th salary and a vacation bonus of one third, and employer INSS, RAT, third-party levies and FGTS fall on all of it with no ceiling. That is why the statutory employer cost is a flat 50.9% at R$2,700, R$8,100 and R$27,000. The collective agreement for the role then adds its own salary floor, a mandatory annual raise and often meal vouchers. Price a role in the EOR cost calculator.

Employment terms and working conditions

Brazil rewrote its working week by constitutional amendment in October 2026 and changed income tax and paternity leave by statute, so contracts signed this year need checking against the first group.

Cost of employment

Cost of employing someone in Brazil

Brazil puts no ceiling on employer INSS or FGTS, so the statutory burden stays at 50.9% of gross from an entry salary to a senior one, and only the employee side changes as pay rises.

Junior
R$2,700 a month
50.9% of gross
INSS employer and RATR$660
Third-party levies (Sistema S)R$174
FGTS depositR$240
13th salary and vacation bonusR$300

At 1.7 times the minimum wage, the 13th salary and vacation bonus add R$300 a month, and all four payroll charges fall on that too. Total cost is R$4,074. The employee pays no income tax at this level under the R$5,000 exemption.

Mid-level
R$8,100 a month
50.9% of gross
INSS employer and RATR$1,980
Third-party levies (Sistema S)R$522
FGTS depositR$720
13th salary and vacation bonusR$900

The employer percentage does not move. On the employee side, INSS still applies in full because R$8,100 sits just under the R$8,475.55 contribution ceiling, and income tax is back on the full progressive table above R$7,350. Total cost is R$12,222.

Senior
R$27,000 a month
50.9% of gross
INSS employer and RATR$6,600
Third-party levies (Sistema S)R$1,740
FGTS depositR$2,400
13th salary and vacation bonusR$3,000

Employee INSS stops at the R$8,475.55 ceiling, but nothing caps the employer side. Each extra real of salary still costs R$1.51 in total, so a R$27,000 hire costs R$40,740 a month, and senior hires carry the same 50.9% as juniors.

Rates for 2026, monthly averages. Employer INSS 20% (Lei 8.212/1991 art. 22 I) and RAT 2% (art. 22 II; the legal rate is 1%, 2% or 3% by activity, multiplied by an FAP of 0.5 to 2.0, so 0.5% to 6% in practice; we assume 2%, the rate for CNAE 7830-2/00, human resources supply for third parties, with an FAP of 1.0) apply with no ceiling. Third-party levies of 5.8% assume FPAS 515 for commerce and services: salário-educação 2.5%, INCRA 0.2%, SESC 1.5%, SENAC 1.0% and SEBRAE 0.6% (IN RFB 2.110/2022, Annex III, as replaced by IN RFB 2.321/2026 from April 2026). FGTS is 8% of pay, deposited by the 20th of the following month (Lei 8.036/1990 art. 15). The 13th salary (Lei 4.090/1962) and the one-third vacation bonus (Constitution art. 7 XVII) are accrued as 1/12 and 1/36 of monthly salary, and the four charges also fall on them, so each charge runs at 10/9 of its headline rate. Not included: the 40% FGTS fine, owed only on dismissal without cause; transport vouchers above 6% of salary; and benefits set by the collective agreement. Employers on Simples Nacional, or still in the CPRB payroll relief regime (50% of the payroll rate in 2026 and 75% in 2027 under Lei 14.973/2024), pay less, so ask which regime the EOR entity uses. Employee INSS ceiling R$8,475.55 from Portaria Interministerial MPS/MF 13/2026. Compare rates with other countries in employer payroll tax rates by country.

Misclassification risk. Labour courts apply the CLT art. 3 test, and a PJ who works personally, regularly, for pay and under your direction is an employee whatever the contract says, with back 13th salaries, vacation, FGTS plus the 40% fine and INSS owed for up to five years. The STF froze the national question in Tema 1.389 in April 2025, and when we checked in October 2026 the merits ruling was still pending, while lower courts have heard PJ cases again since 18 June 2026. See what misclassification costs by country.

Leave and benefits

Vacation: CLT arts. 130, 134, 137, 143 and 145; one-third bonus under Constitution art. 7 XVII. National holidays for 2026: Portaria MGI 11.460/2025; municipalities may set up to four religious holidays under Lei 9.093/1995. Sick pay: Lei 8.213/1991 art. 60; accident job security art. 118. Maternity: Constitution art. 7 XVIII, CLT art. 392 and ADCT art. 10 II b; the employer pays and offsets the amount against its INSS contributions. Empresa Cidadã extensions (60 days maternity, 15 days paternity) are open to companies taxed on actual profit (lucro real) under Lei 11.770/2008. Paternity: ADCT art. 10 §1 until 31 December 2026, then Lei 15.371/2026, under which the employer pays salário-paternidade and is reimbursed by INSS. When we read Lei 15.371 in October 2026, the 20-day step for 2029 depended on the government meeting its fiscal target, so do not budget for it yet. Transport voucher: Lei 7.418/1985. The 13th salary is covered in 13th month pay by country.

Termination

Termination and offboarding

An employer in Brazil can dismiss without giving a reason, but the type of exit sets the bill: a dismissal without cause brings notice of up to 90 days and a fine of 40% on every FGTS deposit made during the job.

FGTS fine: Lei 8.036/1990 art. 18 §1 and Decreto 99.684/1990 art. 9, also owed on early termination of a fixed-term or experience contract (art. 14). Experience contracts: CLT arts. 479 and 481. Final dues and the termination statement must be paid within 10 days of the end of the contract, or a fine of one month’s salary applies (CLT art. 477 §§6 and 8). Pregnant employees, union officers, elected CIPA members and employees back from accident leave hold job security. Collective agreements can add notice or severance above the CLT. Mass dismissals need prior union involvement after the STF ruling in Tema 638 (2022).

Getting started

From decision to first payroll in four weeks

Through an employer of record, a first CLT hire takes three to four weeks, and most of that goes on identifying the collective agreement and booking the admission medical exam.

1Week 1

Pick the route

Choose between an EOR and a Ltda, and test any current PJ contracts against CLT art. 3. Ask the EOR which FPAS code and RAT rate its entity pays, because both move the 50.9% figure.

2Week 1

Find the agreement

Ask the EOR which union and convenção coletiva cover the role in the employee’s city. Note the salary floor, the base month for the annual raise, and any meal voucher or health plan duty.

3Week 2

Issue the contract

Sign a CLT contract with an experience period of up to 90 days, the salary, hours that respect the 42-hour week from 16 December 2026, and telework terms if the job is home-based.

4Week 3

Exam and eSocial

The employee takes the admission medical exam (ASO) under NR-7 and supplies a CPF and bank details. The EOR sends the S-2200 admission event to eSocial before the first working day.

5Week 4

Run first payroll

Salary is due by the 5th business day of the next month. The FGTS deposit goes through FGTS Digital by the 20th, and INSS, RAT and third-party levies are declared in DCTFWeb.

FAQ

Questions employers ask about hiring in Brazil

The eight questions where published Brazil guidance is most often out of date, mostly because of the 2026 changes to hours, income tax and contractor rules.

Does a Brazilian employee really cost 70% to 80% more than salary?

Not on statutory items alone. The statutory employer cost is 50.9% of gross at any salary: 22% INSS and RAT, 5.8% third-party levies and 8% FGTS, all charged on salary plus the 13th salary and the one-third vacation bonus, plus those two accruals themselves. The 70% to 80% figures quoted online add benefits that are customary or set by the collective agreement, such as meal vouchers, health plans and transport vouchers, and sometimes a reserve for the 40% FGTS fine. Budget for those separately, role by role.

Can I keep paying a Brazilian developer as a PJ?

Only if the relationship is genuinely independent. A labour court reclassifies a PJ who works personally, regularly, for pay and under your direction (CLT art. 3), and orders back 13th salaries, vacation, FGTS with the 40% fine and INSS for up to five years. The STF has not decided Tema 1.389 on PJ contracts: when we checked in October 2026 the merits ruling was still pending. Moving the PJ onto a CLT contract through an EOR ends the exposure from that date, as our contractor conversion guide explains.

What does the end of the 6×1 schedule change for my employees?

Constitutional Amendment 141, promulgated on 16 October 2026, cuts the normal week from 44 to 42 hours from 16 December 2026 and to 40 hours from 16 December 2027 under the amendment text, which counts two months and then one year from publication, with two paid rest days a week and no salary cut. The monthly salary stays the same, so the hourly rate rises, and overtime calculated on the standard divisor gets dearer as the monthly divisor falls from 220 (to 210 at 42 hours and 200 at 40 hours, according to a Fenacon technical note applying CLT art. 64; neither the labour ministry nor the TST had issued guidance on the divisor when we checked in October 2026). Six-day rosters must change by 16 December 2026. Collective agreements can still spread hours across the week within the 8-hour daily limit.

Does the R$5,000 income tax exemption cut my payroll cost?

No. Lei 15.270/2025 removes income tax withholding on monthly pay up to R$5,000, and reduces it up to R$7,350, from January 2026. That raises the employee’s net pay. The employer’s INSS, RAT, third-party levies and FGTS are charged on gross salary and do not change. On the Junior salary of R$2,700 the employee has no income tax withheld, while R$8,100 and R$27,000 stay on the normal progressive table. Net-pay offers drafted in 2025 overstate the tax a lower-paid employee now pays.

Do I owe the 40% FGTS fine if the employee resigns?

No. The 40% fine on all FGTS deposits is owed only when the employer dismisses without cause, including early termination of an experience or fixed-term contract. On a resignation the employer pays the balance of salary, accrued vacation with its one-third bonus and the proportional 13th, and the employee cannot withdraw the FGTS balance. A mutual agreement under CLT art. 484-A halves the fine to 20% and lets the employee draw 80% of the balance, but it rules out unemployment insurance, so the employee has to want it.

Which collective agreement applies when I hire through an EOR?

Normally the one for the EOR entity’s economic category in the city where the employee works, not your company’s sector abroad. That convenção coletiva sets the salary floor, a mandatory raise in its base month and benefits such as meal vouchers or profit sharing, and it can improve notice and overtime terms. Ask the EOR to name the union and agreement before you make an offer, because the annual raise can land a few months after the start date. Members of differentiated categories, such as drivers, follow their own agreement.

Can an employer of record sponsor a work visa in Brazil?

Yes, if it employs through its own Brazilian entity. The temporary work visa needs a job offer evidenced by an employment contract (Decreto 9.199/2017 art. 38), which the EOR entity signs before filing the authorisation request. A provider using a partner entity may not be able to sponsor. Mercosur nationals and spouses of Brazilians can work without a sponsored visa. The digital nomad visa does not allow work for a Brazilian employer, so it cannot cover an EOR hire. More in can an EOR sponsor a work visa.

How quickly must final pay be made after a dismissal?

Within 10 days of the end of the contract, whether notice is worked or paid in lieu (CLT art. 477 §6). The payment covers the balance of salary, notice pay if indemnified, vested and proportional vacation with the one-third bonus, the proportional 13th and, on a dismissal without cause, the 40% FGTS fine deposited to the employee’s account. Missing the deadline costs a fine of one month’s salary under art. 477 §8, on top of any correction a labour court orders. The exit is also reported to eSocial.
